Efforts to strip antitrust immunity from transborder airline joint ventures have a long history, and the pattern in past episodes is that the unwind process, once initiated, has tended to stall in the courts because immunity orders carry substantial reliance interests and coordinated network schedules are hard to disentangle mid-stream. Joint ventures of this kind sit at the centre of the revenue model on the routes they cover: coordinated pricing, scheduling and revenue sharing across the partner's metal, which is why the immunity question matters more to the carriers' economics than a routine regulatory setback would. The distinction worth drawing is between the legal status, now preserved pending any further appeal, and the commercial trajectory, which historically has continued largely undisturbed during litigation of this sort. The follow-ons are whether the department petitions for further review, and whether the ruling has read-across to other immunised alliances facing periodic scrutiny. For the equity, precedent suggests the lasting sensitivity is less the single ruling than any signal that slot divestiture or capacity remedies resurface in a subsequent round.
